The company Sylvaine Delacourte SAS offers via its Website www.delacourte.com the discovery and sale of cosmetic products (perfumes, candles, soaps, oils, etc.) to individuals and professionals.
These activities are carried out under the name Delacourte Paris and are operated by the Website www.delacourte.com. The website is open to all users of the Internet network.
These General Terms and Conditions aim to define the rights and obligations of the parties in connection with the sale of products and services to Customers of the Website (hereinafter "the Website").
Any order placed implies the acceptance of these General Terms and Conditions, which the Customer acknowledges having read, understood, and accepted with full knowledge of the facts. These General Terms and Conditions are subject to French law. Sylvaine Delacourte SAS reserves the right to modify these General Terms and Conditions at any time, without notice, it being understood that such modifications will not apply to orders previously accepted and confirmed.

The products and services of Sylvaine Delacourte SAS are shipped worldwide. Eligible delivery destinations are automatically proposed and updated at the checkout stage according to the logistical capabilities of our partner carriers. For customs, legal, or logistical reasons, any order destined for a geographical area not covered by our system during checkout cannot be finalized.
5/ Availability of services
The services of the Website are normally accessible 24 hours a day, 7 days a week, except in the event of voluntary or involuntary interruption (notably for maintenance). Being subject to an obligation of means, the company Sylvaine Delacourte SAS cannot be held liable for any damages caused by the unavailability of the Website.
6/ Prices
The sales prices appearing on the Website are indicated in the currency selected by the Customer or automatically geolocated (notably in Euros, Dollars, Pounds Sterling, Swiss Francs, Yen, etc.), inclusive of all taxes. Products are billed at the prices in effect at the time the order is recorded.
Prices may be modified at any time; the modification will be notified to the Customer prior to any Order. All our prices include shipping costs regardless of the Customer's order amount (unless stated otherwise during checkout).
Prices include the value-added tax (VAT) applicable on the day of the Order. Any change in the VAT rate will be automatically applied.
7/ Characteristics and conformity of the products
Sylvaine Delacourte SAS may modify the assortment of products at any time. In accordance with Article L. 111-1 of the French Consumer Code, the Customer may familiarize themselves with the essential characteristics of the products before ordering. The products comply with current French legislation.
8/ Availability
Offers are valid as long as they are announced on the Website and within the limits of available stocks. In the event of unavailability after placing the Order, the Customer will be notified by email and refunded or not charged for the missing products. Sylvaine Delacourte SAS cannot be held liable for any damages suffered.
9/ Orders and Right of withdrawal
The validation of the Order implies acceptance of these General Terms and Conditions, prices, volumes, characteristics, and delivery times. Sylvaine Delacourte SAS will confirm the order by email.
Sylvaine Delacourte SAS reserves the right to cancel any Order in the event of payment default, payment incident, or suspected fraud. In the event of an error in the email address entered by the Customer, the company's liability cannot be engaged.
Right of withdrawal: The Customer has a period of 14 days from the receipt of the order to exercise their right of withdrawal. Sylvaine Delacourte SAS will refund the full amount paid. The products must be returned in perfect condition and in their protective packaging (intact cellophane). Return shipping costs are the responsibility of the Customer.
Returns must be made to the following address: Axe Systems, Attn Sylvaine Delacourte, 11 rue du Général Mocquery, 37550 Saint Avertin, France. The use of a tracked delivery method is strongly recommended. The Customer may notify their withdrawal by email to hello@delacourte.com.
10/ Specific conditions for the Discovery Set
Sylvaine Delacourte SAS reserves the right to cancel any order for a discovery set that exceeds a strictly discovery-oriented use (limited to 1 set per person).
11/ Payments
Purchases are settled via highly secure payment platforms, providing great flexibility to the Customer. We accept credit cards, PayPal, as well as a selection of local and digital payment methods adapted to your country (such as Bancontact, Apple Pay, etc.), dynamically proposed during the validation of the order.
The Customer guarantees to Sylvaine Delacourte SAS that they are fully authorized to use the selected payment method. All payments are processed through a data encryption procedure so that no information can be intercepted. Sylvaine Delacourte SAS reserves the right to suspend or cancel any order in the event of suspected fraud or a payment incident.
12/ Delivery of orders
i) Delivery of the discovery set in France
When ordering, the Customer can choose between several shipping methods operated by La Poste: Lettre Verte, Lettre Verte Suivie, or Colissimo. Estimated delivery times vary from 2 to 10 business days depending on the selected option. The package is deposited in the mailbox or handed over against a delivery notice.
ii) Delivery of the perfume set in France
Delivery by Colissimo from La Poste (2 to 3 business days). Deposited in the mailbox or handed over against a delivery notice.
iii) Delivery of the discovery set internationally (excluding USA)
When ordering, the Customer can choose between standard delivery via Lettre Prioritaire Internationale from La Poste (estimated time of 2 to 3 weeks) or express delivery via Chronopost.
iv) Delivery of the perfume set internationally (excluding USA)
Delivery by Colissimo International (3 to 10 business days).
v) Delivery of orders to the United States
To guarantee rapid service to our American customers, orders destined for the United States are shipped from our warehouse located in New Jersey. Delivery is entrusted to the most suitable carrier for your address (USPS, UPS, or Amazon Logistics). In the event that delivery to a mailbox is impossible, the carrier's local rules apply.
For all delivery methods, no dispute regarding the delivery itself is possible if the package appears to have been delivered, with the carrier's tracking system serving as proof. In the event of failure to collect the package within the timeframe and its return to the sender, the Order amount will be refunded, minus the delivery costs.
13/ Retention of Title
Sylvaine Delacourte SAS retains full ownership of the products until the full price has been collected.
14/ Intellectual property
All elements of the Website (texts, illustrations, trademarks) are protected. Any reproduction is strictly prohibited.
15/ Signature and proof
The Customer must maintain the security of their transactions (protection of their credentials). Sylvaine Delacourte SAS cannot be held responsible for the fraudulent use of this information. The computerized records kept by the company will serve as proof of communications and payments.
16/ Deactivation of the customer account
In the event of non-compliance with the General Terms and Conditions or fraud, Sylvaine Delacourte SAS reserves the right to suspend or terminate the Customer's account.

18/ Liability

23/ Partial invalidity and 24/ Non-waiver
The invalidity of one clause does not affect the others. The failure to exercise a right does not constitute a waiver of that right.
25/ Applicable law and competent jurisdiction
Any dispute will be subject to the competent French courts.
